3.1    In this Section 3 we have set out the general categories of personal data that we process and, in the case of personal data that we did not obtain directly from you, information about the source and specific categories of that data.

3.5    We may process information contained in or relating to any communication that you send to us or that we send to you (“communication data“). The communication data may include the communication content (eg. feedback about our services, partnership inquiry details (such as organizational size, number of people to train, organization’s training needs)) and metadata associated with the communication. The source of the communication data is you and/or your employer. Our website will generate the metadata associated with communications made using the website contact forms.

The usage data may include your IP address, geographical location, browser type and version, operating system, referral source, length of visit, page views and website navigation paths, as well as information about the timing, frequency and pattern of your service use. The source of the usage data is our analytics tracking system and/or webshop system.

3.7    Where usage data or similar information is collected via technologies subject to consent under §165 TKG 2021, such processing takes place only in accordance with this policy and applicable cookie consent requirements.

4.1    In this Section 4, we have set out the purposes for which we may process personal data and the legal bases of the processing.

VAT identification numbers provided in the context of business transactions are processed and validated for the purposes of tax compliance and correct invoicing in accordance with applicable EU and Austrian tax law.

4.11  Notwithstanding the legal bases listed above, the storage of information on your end device or the access to information already stored there (in particular through cookies, pixels, local storage or similar technologies) is carried out exclusively in accordance with § 165 TKG 2021. 6. International transfers of your personal data

6.1    In this Section 6, we provide information about the circumstances in which your personal data may be transferred to a third country under EU data protection law. 7. Retaining and deleting personal data

7.1    This Section 7 sets out our data retention policies and procedures, which are designed to help ensure that we comply with our legal obligations in relation to the retention and deletion of personal data.

7.2    Personal data that we process for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes.

7.3    The following general periods apply to data retention and archiving under Austrian law:

    • 10 years – Retention period for books and records, financial statements, inventories, management reports, opening balances, booking receipts, invoices, and all required instructions and other organizational documents (Federal Fiscal Code (BAO §132), Commercial Code (UGB §§190-212)).
    • 6 years – Other business documents: received commercial or business letters, copies of sent commercial or business letters, and other documents relevant for taxation. These include, for example, hourly wage records, operational cost statements, pricing documents, and payroll records, provided they are not already booking receipts or cash register receipts (BAO §132, UGB §§190-212).
    • 3 years – Data required to consider potential warranty and damage claims or similar contractual claims and rights, as well as associated inquiries, will be stored for the duration of the regular statutory limitation period of three years (§§ 1478, 1480 ABGB).

7.4    In some cases it is not possible for us to specify in advance the periods for which your personal data will be retained. In such cases, we will determine the period of retention based on the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

7.5    Notwithstanding the other provisions of this Section 7, we may retain your personal data where such retention is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.

Once you click the confirmation link in the email, the requested process will be automatically and irreversibly executed. In exceptional cases where statutory retention obligations or overriding legal grounds apply, requests will be reviewed and processed manually.
